Recent Victories
C.C. - Possession of Marijuana, San Antonio, Bexar County - C.C. is married, with children, and works in the Eagle Ford, where he is drug-tested regularly. On a summer afternoon C.C. was pulled over and arrested for possession of marijuana. The cop wrote in his report that he pulled the car over for not having a front license plate, then smelled marijuana, searched the car and found .21 ounces of weed. However, the cop left out of his report the fact that he told C.C. that he pulled him over because he looked suspicious, that the license plate was on the front dash, and the fact that there were four other people in the car. Clearly the weed belonged to one of the other four people, or the cop planted it there himself. The cop also took C.C.'s phone and illegally searched through the phone, looking for "evidence." The cop never gave the phone back and claimed the tow truck driver must have stolen it. Tommy Vaughn took the case and set it for trial. The DA dismissed the case as the jury stood in the hallway. The cop didn't show up for trial, probably because he was afraid to be exposed under cross-examination. February 23, 2015
A.E. - Possession of Marijuana, San Marcos, Hays County - A.E. was pulled over for speeding on the way to the Drake concert and arrested for possession of marijuana. Tommy Vaughn was able to get the prosecutor to offer a pre-trial diversion to avoid a conviction. Most lawyers would have told their client to take the deal, however Tommy Vaughn continued his attack on the case and ultimately convinced the prosecutor to dismiss the case completely.

K.D. - Possession of Marijuana, San Antonio, Bexar County - K.D., an Afghanistan war veteran, was pulled over for making an illegal left turn. The cop saw K.D. trying to eat marijuana and placed him under arrest. The cop later searched the car and found a baggie of marijuana in the center console. The cop charged K.D. with Possession of Marijuana and Felony Tampering with Evidence. K.D.'s first lawyer tried to convince K.D. to plead guilty and accept probation. K.D. fired his first lawyer and chose Tommy Vaughn to fight for him. Tommy Vaughn brought the fight to the DA and convinced the Judge that the cop had no legal reason to pull over K.D. in the first place. The Judge suppressed all the evidence the DA tried to use against K.D. and the charges were dismissed. March 6, 2014
B.H. - Felony Possession of Cocaine 1-4 grams, Lockhart, Caldwell County - B.H. was stopped and arrested by Lockhart police for driving with a suspended license. Lockhart police officers searched the car and found cocaine and marijuana and charged B.H. with a Third Degree Felony, where he faced 10 years in prison. B.H. got an attorney who continuously tried to convince him to plead guilty and agree to a lesser prison sentence. After months of being pressured to plea guilty, B.H. fired his lawyer and Tommy Vaughn, his Lockhart Drug Lawyer, began his defense by immediately setting the case for trial. I was able to subpoena the cop's personnel files from the Police Department, even though they fought me hard over their release. On the eve of trial, the Judge listened to my legal arguments after I cross-examined the arresting officer and agreed that the cop illegally arrested B.H. After the Judge granted my Motion to Suppress, the District Attorney had no choice but to dismiss all the charges against B.H. September 26, 2013.
K.W. - Possession of Marijuana 2-4 ounces, San Antonio, Bexar County - K.W. was pulled over at 3:30 am on Loop 410. The cop said K.W. was drifting in and out of his lane and had an expired registration sticker. The cop said he could smell a "strong and overwhelming smell of marijuana coming from the vehicle." The cop handcuffed K.W. and said K.W. "had a strong odor of marijuana on his person, hands, and breath." K.W. admitted to smoking marijuana earlier while playing video games. The cops searched the car and found marijuana on the driver's side floorboard, center console, and in the gear shift, as well as fifteen bags of marijuana in a backpack in the front passenger seat. I was able to convince the District Attorney that she would not be able to prove that K.W. knew that the marijuana was in the car, or that she would be able to prove that it was K.W.'s. The District Attorney realized this was not a case worth fighting me over and dismissed the case on the first court date. September 20, 2013.
H.B. - Possession of Marijuana and Possession of a Controlled Substance, Castle Hills, Bexar County - H.B. was a passenger in a car that was pulled over because a front headlight was burned out. The cop thought that the driver and passenger were "acting really nervous," so he ordered H.B. out of the car and called for a female officer to frisk H.B. Before the cop began to pat her down, H.B. pulled a pill container out of her pocket, which contained marijuana and Xanax. H.B. had never been in trouble before and wanted to take the DA's offer for probation because she was afraid of going to jail. H.B.'s San Antonio Drug Lawyer told her that the cop's actions were illegal and that she could beat the case. I immediately set the cases for trial and successfully argued that the cop had no legal justification for detaining and searching H.B. H.B. will be able have these cases expunged so that her record is still clean. September 10, 2013
D.W. - Driving While Intoxicated, New Braunfels - Dismissed August 29, 2013
C.P. - Possession of Marijuana, New Braunfels - During a traffic stop, C.P. admitted to smoking marijuana and having a "little stash" in his car. C.P's New Braunfels Drug Defense Attorney went on the offensive, attacking the cop's legal justifications and motives for the stop and got the charge thrown out of court. Put that in your pipe and smoke it.
P.W. - DWI, San Marcos - P.W. was charged with an enhanced DWI because of extreme intoxication. P.W. was recklessly speeding on the interstate and almost caused numerous wrecks before almost crashing into a State Trooper. P.W. failed all of the roadside sobriety tests and blew almost 3 times the limit. P.W. lived out of state and would have had to spend thousands of dollars traveling to Texas to appear in court. P.W.'s San Marcos DWI Attorney was able to convince the Judge of P.W.'s extenuating circumstances and to consider the night spent in jail after her arrest as punishment enough. P.W. was more than thrilled to not have to come back to San Marcos to deal with the charge.
R.J. - Felony Possession of a Controlled Substance, San Marcos - San Marcos police pulled R.J. over for failing to maintain a single lane of travel. The cop smelled marijuana in the vehicle and R.J. admitted to having a pipe in his pants pocket. The cop frisked R.J. and found 1.1 grams of methamphetamine in R.J.'s shirt pocket. R.J.'s San Marcos Drug Defense Lawyer moved to suppress all of the evidence and was able to show that the cop did not have a legal justification to pull R.J. over and the case was dismissed.
J.S. - Intoxication Assault, Seguin - J.S. flipped his truck going around a curve, severely injuring a passenger riding in the bed. A DPS Trooper accused J.S. of failing a sobriety test. J.S.'s blood alcohol level was taken almost 3 hours after the accident and was 0.069, just below the limit. A Guadalupe County Grand Jury indicted J.S. for intoxication assault. J.S.'s Seguin DWI Attorney was able to cast doubt on the Trooper's probable cause to make the arrest and other crucial State evidence and the charge was dismissed.
V.T. - DWI - New Braunfels - V.T. was stopped on I-35 for failing to maintain a single lane of travel and drifting out of her lane. V.T. failed the road side agility tests and then failed the breath test. V.T. had been convicted of DWI once before and so this was an enhanced DWI charge. V.T.'s New Braunfels DWI Attorney was able to argue that the cop had no legal justification for pulling V.T. over in the first place and the case was dismissed.
D.B. - Reckless Driving and Unlawfully Carrying a Handgun, San Antonio - D.B. was accused by a Bexar County Sheriff Deputy of failing to yield the right of way, driving into oncoming traffic, failing to stop at before a stop sign, driving on an unimproved shoulder, and driving at a high rate speed and fishtailing around a turn. The Sheriff originally accused D.B. of being DWI but instead charged with him reckless driving and possession a handgun while committing a crime. D.B.'s San Antonio DWI Attorney immediately demanded a jury trial and was able to successfully call the Sheriff's truthfulness and ulterior motives into question and was able to convince the prosecutor to dismiss all charges on the morning of trial. R.M. - Reckless Driving, New Braunfels - R.M. was originally arrested for DWI-2d, but had the charge reduced to Reckless Driving and given probation. R.M. fell behind in paying fines and court costs and the Judge ordered client to serve 20 days in jail, then attend AA meetings for 90 days and complete a DWI prevention class. R.M.'s New Braunfels DWI Attorney was able to convince the judge to terminate R.M.'s probation without R.M. having to spend another day in jail or pay another dime to the court system.
S.G. - Possession of Marijuana, San Antonio - S.G. was pulled over by a Bexar County Sheriff for having an illegible rear license plate and failing to signal a lane change. When speaking to my client, the deputy could smell a strong odor of marijuana coming from the car. The deputy searched the car and found 0.3 ounces of marijuana in a plastic bag in between the driver's seat and the center counsel. A.E. - Possession of Marijuana, San Marcos, Hays County - A.E. was pulled over for speeding on the way to the Drake concert and arrested for possession of marijuana. Tommy Vaughn was able to get the prosecutor to offer a pre-trial diversion to avoid a conviction. Most lawyers would have told their client to take the deal, however Tommy Vaughn continued his attack on the case and ultimately convinced the prosecutor to dismiss the case completely.

K.D. - Possession of Marijuana, San Antonio, Bexar County - K.D., an Afghanistan war veteran, was pulled over for making an illegal left turn. The cop saw K.D. trying to eat marijuana and placed him under arrest. The cop later searched the car and found a baggie of marijuana in the center console. The cop charged K.D. with Possession of Marijuana and Felony Tampering with Evidence. K.D.'s first lawyer tried to convince K.D. to plead guilty and accept probation. K.D. fired his first lawyer and chose Tommy Vaughn to fight for him. Tommy Vaughn brought the fight to the DA and convinced the Judge that the cop had no legal reason to pull over K.D. in the first place. The Judge suppressed all the evidence the DA tried to use against K.D. and the charges were dismissed. March 6, 2014
B.H. - Felony Possession of Cocaine 1-4 grams, Lockhart, Caldwell County - B.H. was stopped and arrested by Lockhart police for driving with a suspended license. Lockhart police officers searched the car and found cocaine and marijuana and charged B.H. with a Third Degree Felony, where he faced 10 years in prison. B.H. got an attorney who continuously tried to convince him to plead guilty and agree to a lesser prison sentence. After months of being pressured to plea guilty, B.H. fired his lawyer and Tommy Vaughn, his Lockhart Drug Lawyer, began his defense by immediately setting the case for trial. I was able to subpoena the cop's personnel files from the Police Department, even though they fought me hard over their release. On the eve of trial, the Judge listened to my legal arguments after I cross-examined the arresting officer and agreed that the cop illegally arrested B.H. After the Judge granted my Motion to Suppress, the District Attorney had no choice but to dismiss all the charges against B.H. September 26, 2013.
K.W. - Possession of Marijuana 2-4 ounces, San Antonio, Bexar County - K.W. was pulled over at 3:30 am on Loop 410. The cop said K.W. was drifting in and out of his lane and had an expired registration sticker. The cop said he could smell a "strong and overwhelming smell of marijuana coming from the vehicle." The cop handcuffed K.W. and said K.W. "had a strong odor of marijuana on his person, hands, and breath." K.W. admitted to smoking marijuana earlier while playing video games. The cops searched the car and found marijuana on the driver's side floorboard, center console, and in the gear shift, as well as fifteen bags of marijuana in a backpack in the front passenger seat. I was able to convince the District Attorney that she would not be able to prove that K.W. knew that the marijuana was in the car, or that she would be able to prove that it was K.W.'s. The District Attorney realized this was not a case worth fighting me over and dismissed the case on the first court date. September 20, 2013.
H.B. - Possession of Marijuana and Possession of a Controlled Substance, Castle Hills, Bexar County - H.B. was a passenger in a car that was pulled over because a front headlight was burned out. The cop thought that the driver and passenger were "acting really nervous," so he ordered H.B. out of the car and called for a female officer to frisk H.B. Before the cop began to pat her down, H.B. pulled a pill container out of her pocket, which contained marijuana and Xanax. H.B. had never been in trouble before and wanted to take the DA's offer for probation because she was afraid of going to jail. H.B.'s San Antonio Drug Lawyer told her that the cop's actions were illegal and that she could beat the case. I immediately set the cases for trial and successfully argued that the cop had no legal justification for detaining and searching H.B. H.B. will be able have these cases expunged so that her record is still clean. September 10, 2013
D.W. - Driving While Intoxicated, New Braunfels - Dismissed August 29, 2013
C.P. - Possession of Marijuana, New Braunfels - During a traffic stop, C.P. admitted to smoking marijuana and having a "little stash" in his car. C.P's New Braunfels Drug Defense Attorney went on the offensive, attacking the cop's legal justifications and motives for the stop and got the charge thrown out of court. Put that in your pipe and smoke it.
P.W. - DWI, San Marcos - P.W. was charged with an enhanced DWI because of extreme intoxication. P.W. was recklessly speeding on the interstate and almost caused numerous wrecks before almost crashing into a State Trooper. P.W. failed all of the roadside sobriety tests and blew almost 3 times the limit. P.W. lived out of state and would have had to spend thousands of dollars traveling to Texas to appear in court. P.W.'s San Marcos DWI Attorney was able to convince the Judge of P.W.'s extenuating circumstances and to consider the night spent in jail after her arrest as punishment enough. P.W. was more than thrilled to not have to come back to San Marcos to deal with the charge.
R.J. - Felony Possession of a Controlled Substance, San Marcos - San Marcos police pulled R.J. over for failing to maintain a single lane of travel. The cop smelled marijuana in the vehicle and R.J. admitted to having a pipe in his pants pocket. The cop frisked R.J. and found 1.1 grams of methamphetamine in R.J.'s shirt pocket. R.J.'s San Marcos Drug Defense Lawyer moved to suppress all of the evidence and was able to show that the cop did not have a legal justification to pull R.J. over and the case was dismissed.
J.S. - Intoxication Assault, Seguin - J.S. flipped his truck going around a curve, severely injuring a passenger riding in the bed. A DPS Trooper accused J.S. of failing a sobriety test. J.S.'s blood alcohol level was taken almost 3 hours after the accident and was 0.069, just below the limit. A Guadalupe County Grand Jury indicted J.S. for intoxication assault. J.S.'s Seguin DWI Attorney was able to cast doubt on the Trooper's probable cause to make the arrest and other crucial State evidence and the charge was dismissed.
V.T. - DWI - New Braunfels - V.T. was stopped on I-35 for failing to maintain a single lane of travel and drifting out of her lane. V.T. failed the road side agility tests and then failed the breath test. V.T. had been convicted of DWI once before and so this was an enhanced DWI charge. V.T.'s New Braunfels DWI Attorney was able to argue that the cop had no legal justification for pulling V.T. over in the first place and the case was dismissed.
D.B. - Reckless Driving and Unlawfully Carrying a Handgun, San Antonio - D.B. was accused by a Bexar County Sheriff Deputy of failing to yield the right of way, driving into oncoming traffic, failing to stop at before a stop sign, driving on an unimproved shoulder, and driving at a high rate speed and fishtailing around a turn. The Sheriff originally accused D.B. of being DWI but instead charged with him reckless driving and possession a handgun while committing a crime. D.B.'s San Antonio DWI Attorney immediately demanded a jury trial and was able to successfully call the Sheriff's truthfulness and ulterior motives into question and was able to convince the prosecutor to dismiss all charges on the morning of trial. R.M. - Reckless Driving, New Braunfels - R.M. was originally arrested for DWI-2d, but had the charge reduced to Reckless Driving and given probation. R.M. fell behind in paying fines and court costs and the Judge ordered client to serve 20 days in jail, then attend AA meetings for 90 days and complete a DWI prevention class. R.M.'s New Braunfels DWI Attorney was able to convince the judge to terminate R.M.'s probation without R.M. having to spend another day in jail or pay another dime to the court system.
S.G. - Possession of Marijuana, San Antonio - S.G. was pulled over by a Bexar County Sheriff for having an illegible rear license plate and failing to signal a lane change. When speaking to my client, the deputy could smell a strong odor of marijuana coming from the car. The deputy searched the car and found 0.3 ounces of marijuana in a plastic bag in between the driver's seat and the center counsel.
